§ 01 · Privacy Policy

1.1 Data controller. CodeGatewayPath, 22 Avenue Hector Berlioz, 44500 La Baule-Escoublac, France, is the controller for personal data processed through this website, contact desk, and project intake systems. Inquiries may be directed to [email protected].

1.2 Categories of data. We process identification and contact details (name, email, phone, company), project specifications submitted voluntarily via order slips, billing identifiers when payments are settled, and technical logs (IP address, browser agent, timestamps) required for security and service reliability.

1.3 Purposes and legal bases. Data is processed to respond to inquiries, prepare and execute integration service agreements, fulfil statutory accounting obligations under French law, and secure our infrastructure. Processing is based on pre-contractual measures (Art. 6.1.b GDPR), legitimate interests in operating a secure service desk (Art. 6.1.f), and legal obligation (Art. 6.1.c).

1.4 Retention. Order slips and correspondence are retained for the duration of the commercial relationship plus applicable limitation periods (typically five years for accounting records). Technical security logs are retained for no longer than twelve months unless required for incident investigation.

1.5 Recipients. Data may be shared with hosting and infrastructure providers engaged under data-processing agreements solely to operate the site and deliver contracted services. We do not sell personal data to third parties or brokers.

1.6 International transfers. Where sub-processors operate outside the European Economic Area, transfers rely on standard contractual clauses or equivalent safeguards recognised under GDPR Chapter V.

1.7 Your rights. You may request access, rectification, erasure, restriction, portability, or object to processing. You may also lodge a complaint with the CNIL (Commission Nationale de l’Informatique et des Libertés) or your local supervisory authority. Rights requests can be sent to [email protected] and are answered without undue delay.

§ 02 · Terms of Service

2.1 Scope. These terms govern the provision of API integration, microservice orchestration, message queue, webhook, and related technical services offered by CodeGatewayPath to business clients. Detailed deliverables, pricing, and timelines are specified in individual service orders or statements of work.

2.2 Service orders. An order is accepted when CodeGatewayPath confirms the scope in writing (including email). Changes to scope, dependencies, or third-party systems may adjust pricing and schedule and will be documented as order amendments.

2.3 Client responsibilities. The client shall provide timely access to systems, credentials required for integration work, accurate technical documentation, and timely feedback. Delays caused by incomplete client inputs may extend delivery timelines without penalty to CodeGatewayPath.

2.4 Pricing and payment. Prices are quoted in USD unless otherwise stated and are exclusive of applicable taxes unless specified. Invoices are due within fifteen (15) days of issue unless a different schedule is agreed in writing. Late payments may accrue interest at the statutory French commercial rate plus recovery costs. Payment processing may be completed via the secure payment link published on this site.

2.5 Intellectual property. Upon full payment, all intellectual property rights in client-specific deliverables (custom code, schemas, configuration, documentation produced under the order) transfer to the client. CodeGatewayPath retains rights in pre-existing frameworks, libraries, tooling, and know-how, and grants a non-exclusive licence to use such components as embedded in the deliverables.

2.6 Confidentiality. Each party shall protect the other’s non-public technical and commercial information with reasonable care and shall not disclose it except to personnel or subprocessors bound by equivalent obligations, or where required by law.

2.7 Warranty and liability. Deliverables are warranted to conform materially to the agreed specification for thirty (30) days after acceptance. CodeGatewayPath’s aggregate liability under any order shall not exceed the amounts paid under that order, except in cases of gross negligence, wilful misconduct, or liability that cannot be limited by law. Neither party is liable for indirect or consequential damages to the extent permitted by applicable law.

2.8 Termination. Either party may terminate an order for material breach if the breach remains uncured fifteen (15) days after written notice. CodeGatewayPath may suspend services where undisputed invoices remain overdue after notice. Provisions on confidentiality, IP, payment, and liability survive termination.

2.9 Governing law. These terms and any order are governed by French law. Courts of Nantes shall have exclusive jurisdiction, without prejudice to mandatory consumer protections where applicable.

§ 03 · Cookie Policy

3.1 What cookies are. Cookies and similar storage mechanisms are small text or data records placed on your device when you visit a website. They support core functionality, remember preferences, and, in some cases, help measure performance.

3.2 Strictly necessary storage. CodeGatewayPath uses essential storage to remember your cookie-consent choice, maintain session integrity, and secure forms and payment redirects. These items are required for the site to function and cannot be switched off via our consent banner without breaking basic operation.

3.3 Analytics and preference data. We may process limited, aggregated technical telemetry (page performance, error events) to maintain reliability of our integration services. Where such measurement requires consent under ePrivacy rules, it is only activated after you accept via the consent banner.

3.4 Third-party content. Embedded services (for example map embeds or payment processors) may set their own cookies when you interact with them. Their handling of data is governed by their own policies. Links to external payment destinations open in a new tab with appropriate security attributes.

3.5 Managing cookies. You can accept or decline non-essential storage using the floating consent banner on this site. You may also clear stored cookies or block them in your browser settings at any time. Blocking strictly necessary storage may prevent parts of the contact and payment flows from working correctly.

3.6 Consent records. When you accept the banner, your choice is stored in your browser’s local storage so the banner is not shown again on that device. Clearing site data will reset this preference.

§ 04 · Refund & Reimbursement Policy

4.1 Service nature. Integration, audit, and retainer work is custom professional service. Once a sprint, audit window, or retained month has begun, corresponding fees are generally non-refundable because resources have already been allocated to the client’s systems.

4.2 Pre-work cancellations. If you cancel a confirmed order before work has started and before any non-recoverable third-party costs have been incurred, prepaid amounts attributable solely to unstarted scope may be refunded in full or in part at CodeGatewayPath’s reasonable discretion, within fifteen (15) business days of written confirmation.

4.3 Failed deliverables. If a deliverable materially fails to meet the agreed specification and CodeGatewayPath cannot remedy the defect within a reasonable period after written notice, you may request a pro-rata refund or credit for the defective portion. Refunds for remedies are limited to the fees allocated to the affected deliverable.

4.4 Third-party fees. Taxes, bank charges, payment-processor fees, and costs of third-party licenses or cloud resources already incurred on your behalf are non-refundable unless required by law or expressly agreed in writing.

4.5 Retainer months. Monthly SLA retainers are billed in advance for the current period. Unused on-call hours do not roll over unless a written agreement states otherwise. Cancellation of a retainer takes effect at the end of the paid period.

4.6 How to request a refund. Email [email protected] from the address associated with your order, include the invoice or order reference, describe the issue, and attach relevant evidence. We acknowledge requests within two business hours and aim to resolve valid claims within fifteen (15) business days. Approved refunds are returned via the original payment method where feasible.

4.7 Statutory rights. Nothing in this policy limits mandatory rights available under applicable consumer or commercial law. Where such rights conflict with this policy, the mandatory statutory rights prevail.
